Uber driver stopped at petrol station to buy condoms before allegedly raping intoxicated passenger, court hears

41-year-old Uber driver Muhammad Naveed appeared at NSW district court on Tuesday and pleaded not guilty to raping a heavily intoxicated young passenger.

Mr Naveed was earlier arrested after he allegedly raped a 22-year-old female passenger in Sydney on a Saturday night in October 2015.

On Tuesday, the Court heard that Mr Naveed picked up his passenger from a night club in Kings Cross and on route to her home in Eastern suburbs stopped over to buy condoms and a bottle of water.

He then got into the car said, ‘I’ve just got these’.

The crown prosecutor James Trevallion told the Court that upon hearing this, the passenger was confused.

‘She became confused… and did not really understand why the accused was showing her this packet of condoms.’

Mr Naveed then drove in the opposite direction of woman’s home. She was heavily intoxicated, falling asleep and could not keep her eyes open when the Uber driver stopped in a side street and asked if she wanted to move to the back seat, prosecutor said.

The next thing the woman remembers is waking up to find Naveed on top of her.

“She did not have the strength to be able to push him off,” Mr Trevallion .

Afterwards, Naveed drove her home and she fell asleep on the way.

At home, the woman phoned a friend, who called police.

In his defence, Mr Naveed told the court it was ‘consent sex’.

He pleaded not guilty to the charge of having had a sexual intercourse without consent.

The court heard the woman did not pay for the trip nor was asked to pay.

The trial continues.
